My impulse is to oppose the death penalty, but I am conflicted. I remember listening to one of the smartest professors I had. He said, simply, that if you take someone's life you forfeit your own. But there are, of course, varying degrees of involvement and premeditation. There are impulsive murders. There are serial murderers. We try to apply charges that are fitting. I believe that we are all flawed, and each of us can make mistakes. That includes the judicial system. But we try to trust our legal system as fair, and to protect the community. I want to view the death penalty as a deterrent, but it fails in that regard. I'm not sure I want to underwrite the needs of a serial murderer when he/she is in prison. I remain perplexed by the death penalty, yet I always feel a twinge of sadness when I read about the "state" executing someone.

Some say that the death penalty is not a deterrent.
Maybe if they lined them all up and actually started implementing their extermination it would have an impact.
In the old days they hung them 3 days after their sentencing.

DNA is a bitch. Of course these 164 who have been exonerated, because they didn't fucking do it, will have actually done a great service to deter people from killing innocent people. Great idea Lama.

there have been some innocent people executed over the years. they may not have been cleared by dna evidence but cleared by discovery of documented evidence that was suppressed and not turned over to the defense that would have presented a a favorable outcome.
problem with that it takes years to find this and it won't bring back the innocent.
you're dealing with misconduct with the lawyers and police in the justice system in the way they handle evidence, some things are not equal.
If you're going to execute someone, there should be a high standard for it and too many states have a standard where using circumstantial evidence leads a to a conclusion "he prolly" did it instead of "he definitely did it".

I don't think circumstantial evidence should every result in a death sentence.
So the technicalities of the law go both ways.

actually this is the beauty of having 50 separate states
people of like minds can flock together and sink or swim together, as long as the federal government never falls for the idiocy of bailing out a state, which is the logical extension of socialism
and the criminals can likewise decide where to kill people
one "fix" for the death penalty might be limit appeals to state supreme courts for state convictions although that could bump up against the bill of rights if claims are made regarding violations of brady or whatever
