Before the ACA was passed that was legal for the health insurance companies to do. With the ACA being signed into law that practice is no longer legal. The New York Times is reporting that the Obama administration has created more than 30 “special enrollment” categories allowing folks to enroll in Obamacare outside of a normal enrollment period. That has allowed people to wait until they become ill or need medical services to sign up, driving up costs significantly.
Individuals enrolled through these special enrollment periods are utilizing up to 55 percent more services than their open enrollment counterparts.
It leaves individuals with no incentive to enroll in coverage during open enrollment as most can simply wait until they are sick or need services before enrolling and drop coverage immediately after receiving services.
And some of these special enrollment qualifiers are far less than ironclad. Consumers may, for example, be eligible for a special enrollment period in “exceptional circumstances” and in “other situations determined appropriate” by the Centers for Medicare and Medicaid Services. The circumstances may include “a serious medical condition” or “misinformation” about a healthcare plan that interfered with normal plan enrollment.

You are talking about a totally different topic("Group Plans"). You are talking about when a policy holder of a group plan (instead of individual plan) submits a claim and if his policy will cover the claim that was submitted. The claim could fall outside the "Ten minimum benefits" which all health insurance policies must have because of the ACA. I was talking about when an individual submits an application for heath insurance to become a policy holder. Do you even realize what you are saying? The Coop lost money because the ratio of their high risk policy holder to their low risk policy holders was high( unbalanced risk pool). The end result was CLAIMS paid out far exceeded premiums collected. When that happens the insurance company loses money (it doesn't matter what is being insured). We have already covered unbalanced risk pools.
The point I was making in the other post was that in the STATE OF KENTUCKY the percentage insured increased with the passing of the ACA law. A lot of folks got health insurance for the VERY FIRST TIME.
