Murphy was originally nominated in 2010.
His nomination was tabled once (2011), because of the statutory limitations on the Texas Legislature of one Medal of Honor a session, and the nomination must be in a regular session.
There was a subsequent amendment (2013), which allowed 2 nominations.
Here is the process required by the statute and the reference to the statute.
TEX GOV. CODE ANN. § 431.131 : TEXAS LEGISLATIVE MEDAL OF HONOR -
Now Texas Government Code 437.431 from the 2013 amendment, which revised
§ 431.131(d) to include two recipients rather than the one recipient previously.
"(c)
To receive the Texas Legislative Medal of Honor, a service member must be nominated during a regular session of the legislature by majority vote of all the members of a nominating committee consisting of:
(1) the adjutant general or the adjutant general's designated representative;
(2) the lieutenant governor or the lieutenant governor's designated representative;
(3) the speaker of the house of representatives or the speaker's designated representative; and
(4) the chair of the standing committee of each house of the legislature with primary jurisdiction over military and veterans affairs.
(d)
The legislature by concurrent resolution may direct the governor to award the Texas Legislative Medal of Honor to a service member nominated by the nominating committee. The committee chairs serving on the nominating committee shall jointly prepare a concurrent resolution directing the governor to award the medal to a service member nominated.
The legislature may direct the medal to be awarded only during a regular session and may not, during a regular session, direct the medal to be awarded to more than:
(1) one service member for service in the state or federal military forces during the period beginning after 1835 but before 1956; and
(2) one service member for service in the state or federal military forces after 1955."
