you have some examples of people committing treason when there wasn't a war.
Rosenbergs (executed) and that jewish guy (40 years in prison) who gave defense info to Israel.
basically, its anyone who works with a foreign govt in some manner is treasonous.

There has to be a war, but it doesn't say which war. I also assume that the war doesn't need to be going on at that moment. Imagine the charges against someone who gave the disposition of our naval forces in Pearl Harbor to the Japanese 48 hours BEFORE the bombing began. I imagine that they would be charged with treason and not sedition. Removing Trump from office by foul means gave Putin an opportunity to invade Ukraine after Biden reopened the Nordstreem II pipeline. This year allowed Putin to get prepared to CONTINUE operations started under Obama/Biden. The war was there, we just refused to believe it.
As a prosecutor I may charge sedition in order to take the death penalty off the table and get a plea.

Yuppers. That is some smelly fishiness there. It smelled from the get go and now with a couple details from the Sussman indictment, it becomes much more apparent.
A Ruckie phone in "proximity" to Trump tower, a meeting that was a total sham-fest and doctored up computer logs - all knitted together and packaged to give to an eagerly waiting FBI, with nary a question or concern about the veracity of the claims or the source of the alleged evidence.
All of that coming on the heals of them supposedly investigating the Hillary emails, server and Seth Rich. I ain't no Sherlock Holmes, but I could smell that stank with my eyes closed.

As I mentioned, they were trying to tie the Trumps to Alfa Bank.
The FBI was already investigating Alfa Bank. So here come the
Russians with their "dirt" on Hillary - and The Trump kid
surely smelled a rat - and that ended the meeting.
This is how corrupt the "Deep State Swamp" really is.
"Republican" John McCain was peddling the Steele dossier.
Wanna guess what's on Hillary's "missing" e-mails??
Maybe Durham already has some of 'em.

Therefore, the United States Code at 18 U.S.C. § 2381 states: Whoever, owing allegiance to the United States, levies war against them or adheres to their enemies, giving them aid and comfort within the United States or elsewhere, is guilty of treason and shall suffer death, or shall be imprisoned not less than five years and fined under this title but not less than $10,000; and shall be incapable of holding any office under the United States.
