A homestead is generally exempt property but i see no reason why that exemption could not be waived in a carefully crafted NDA. But really, how many providers have valuable, unencumbered real property that they would be willing to put on play as part of an NDA?

There is a court of legal opinion, which may well protect you if you have an NDA. But then there's a court of public opinion in which your NDA is not only worthless, it will actually make your troubles worse. An NDA will only serve to show that you knew what you were doing early on, took steps to conceal your actions, and therefore proves beyond all shadow of doubt that you are the horny bastard the media and every Bible-thumping toady will make you out to be. One might say, for example, that Tiger Woods had a tacit (or so he thought) NDA with his many co-conspirators.

I'm not sure if you can waive an exemption statute or your homestead. It might be against public policy. Interesting question.

A homestead is exempt form seziure. But, If you win a judgement against someone, if they sell their house, you can get those procedes to pay your judgement. Also, the thread is about HDH, so yes, if they are making 10k a night, say 2 times a week that could be $1,000,000 a year. Given that income level, they WILL have something that can be sezied. And, you dont have to list what you will forfit for breaking a contract, just how much.

Well, the question of is it worth persuing suing someone over a NDA breach in this case, is a different question. I thnk that goes back to if your worried about it getting out, should you be doing this at all? Especialy a high profile person
