let's just focus on what he got completely wrong and why. his contention that Trump incited a insurrection is nonsense. and he should know that. there is nothing in Trump's Jan 6th speech that can even remotely be considered "inciting the overthrow of the Government".

which of course we all know Trump never said any such thing. he actually said "peacefully protest". not once did Trump say anything that would or could be considered "inciting an insurrection".
Trump shouldn't even be charged for what happened on Jan 6th and Luttig knows why.

it's disingenuous for a person who was a judge and twice considered for the Supreme Court not to know Brandenburg v Ohio and what that ruling means. he knows perfectly well what the ruling means.
Luttig is a "Never Trumper" conservative and every word he says about Jan 6th and Trump is tainted by this fact.
even the FBI doesn't consider Jan 6th an insurrection now. because it wasn't.
it was nothing more than a rabble that started a riot.
