I did some research on it and brother to brother I say choose FMLA because they will pay you for 3 months and they have to by law give you your job back...that's an awesome rule that Progreseives fought for and won. Take advantage of it...Trey you always want to think lawsuit. Have a lawsuit mindset in all you do. I hear people saying it will follow you around if you use FMLA but fuck it because if they try to fuck with you or discriminate in any way you could get paid. That's how I look at all this shit. Even when I'm out grocery shopping I'm always waiting on someone to give me an opportunity to sue their ass for whatever reason because the way i see it most of these people in affluent areas got money so always be prepared to sue even on the job. Make sure you walk around and document the shit out of everything just like Michael Cohen did it could very well save your bacon one day.

SC, you do not understand the law. I have one company that has been in business for 30 plus years and 3 other smaller companies. I can fire your ass just because I do not like the hat you wore to work today.

Medical records follow you. Doctors love to hang those tags on you. It ensures you have to come back to them. You get a tag hung on you whether it's diabetes or some temporary mental issue it absolutely follows you and creates problems later on down the road. Try getting a life insurance policy with a record of diabetes even if you have it under control without meds. Automatic and astronomical rate increase. Have high blood pressure and a class A CDL? You'll be seeing the doctor every month just to keep your job. Any mental instability will be highly scrutinized and could prevent you from getting a security clearance or affect your ability to travel. This is all legal and not subject to lawsuits. Not ones that are going to pay off anyway.
It goes far beyond being able to file a lawsuit.

You dont know the law...I'd sue you out of business if you tried to fire me or give my job away while I was on FMLA...your hands are tied you are not above the law...you have no choice but to comply.

Oh SC, you are so naive. I have been sued many times over shit like this. For those workers I have deposed and filed unemployment I would pay it if I liked them and they did not start any shit. For those that did try to get at me thru the legal system I ruined them. I make sure they will lose any and all unemployment and whatever state or federal benefits they apply for. And, I have put many in a sad state of legal affairs for themselves due to unpaid taxes and child support. Open a can of can of worms and see what happens. Your socialistic views may work in California but not Texas. Why don't you move somewhere so you will feel comfortable...It is obvious Texas is not a place for you.

Companies lose lawsuits everyday most if they're smart will settle. I think you're straight up lying. Let me ask you a simple question. School me, ha! The family leave medical act has its place and is well respected in the employer/employee relationship. Most employees have no clue of the true law that our govt has given them for protection. Most of these employees are good hard working people in a long term career. They will take the leave of absence and return to work. In my experience it is a female that has a baby. She will return to work and in most instances do a better job because she has another mouth to feed. The problem arises with the employees that abuse the law. You seem to skirt that way. SC, you should use the existing laws on the books to promote your ideals in a different realm. You are a bitter person who wants to skirt the law for you own agenda.!
