If you offered to pay a undercover cop posing as a prostitute with a check do you think you could get off a Solicitation of Prostitution charge by claiming that a check is not money?

Y'all will argue about the stupidest things.
By definition a check is not money a check is document that promises to pay a specific amount of money upon it's presentation or after a set amount of time.
In practice and because of laws set forth a check is as good as money, almost. There is still more risk involved in accepting a negotiable instrument over accepting currency.
In the case of this thread the premise that those checks were not accepted as money is attorney double speak horseshit.

Ronnie Earl is enshrined in the pantheon of corrupt district attorneys in Texas, no small accomplishment. His failed political prosecutions rank as some of the most notorious in history. For all of his mischief he has suffered no negative consequence other than the infamy from informed people, and maybe kept him from successful political runs at elected office, including Lieutenant Governor.
Politically based prosecutions like DeLay's highlight the incredible un-checked power of corrupt attorneys general, including Eric Holder. This stuff matters. Alaska senator Ted Stevens was hounded out of office by well timed, politically motivated prosecutions, later overturned. Ted's ordeal was so corrupt that even Eric Holder was forced to discipline his prosecutors. What was the upshot, other than Stevens' legal defense expenses and loss of office? Stevens loss gave Democrats their brief supermajority that greased the skids for the worst piece of legislation ever to excrete from the Senate...........drum roll................The Affordable Care Act (Obamacare), destined to be enshrined in an equally odorous pantheon of infamous laws. Without that brief supermajority (later permanently disabled by Scott Brown's brief tenure as Massachusetts senator) we would have meaningful, constructive progress on health care reform with bipartisan compromise. Instead we have the liberal/Democratic/progressive/socialist dream that will ultimately come unwound.
