Then he must have been absent the day when they went over that you can't legally contract to do something illegal. In the same line of thought you can't sue a hitman for not killing the victim. He might be able to claim false advertising or some kind of deceptive business practice, but then it becomes a "he said, she said" type of argument since I doubt there was a written contract stating she would stay a certain amount of time. In court it's not about the truth, it's about what you can prove.
