I am sure his Defense Team knows that his Jury will be Military Officers, not the OJ Jury.

Maybe when you are faced with the indefensible, you just make up the most assine thing that comes to mind.

Or maybe we are in Bizzaro World, where a Secretary of State can use a private E-Mail Server to carry on the most classified and sensitive of State Dept Communications, or where a smarmy little Demagogue can be elected President, ........twice.

Bergdahl is probably counting on a Presidential Pardon anyway. After all, he "served with honor", according to "rat face" Susan Rice.
