Thanks SJ. Your comments and clarifications are always appreciated. One reason to stear folks to the legal forum is many questions have already been answered there. Several lawyers on the board take the time to answer questions there and I would hate fot them to quit because the same stuff is asked in many different places.

Just incase it's what was already addressed on the legal forum thread:
§ 43.02: PROSTITUTION
(a) A person commits an offense if he knowingly: (1) offers to engage, agrees to engage, or engages in sexual conduct for a fee; or
(2) solicits another in a public place to engage with him in sexual conduct for hire.
It's either/or....not and, with regard to the "public place" part. It also doesn't fail to meet the criteria just because the offer/agreement is not verbalized. Among many other possible things, those crisp $20/$100s and/or the white envelop in your/her possession or on the night stand will likely do LOL
Unless there's just NO evidence in the case, you will have a hard time convincing a judge or a jury of your "peers" (likely maw, paw, and gra'maw ) that wasn't exactly what was going on, simply because you didn't pick her up on the street and never talked about money in exchange for services (though it's still a good idea to avoid doing it).
If there's something I'm missing, let me know. Though it's not uncommon, I have to think that if there really was a serious flaw in the statute, the word would have probably gotten out to more people by now LOL
In any case, as any number of wrongfully convicted people can attest, justice isn't always done, even when it might seem as clear as day. Don't ever let your guard down, no matter how sure you might be.

The production of professional porn generally falls under the statute cited below:
§ 43.02: PROSTITUTION
(a) A person commits an offense if he knowingly:
(1) offers to engage, agrees to engage, or engages in sexual conduct for a fee; or
Though I do know of situations where amateur porn was filmed then later distributed for a fee. I am not aware of any prosecutions in those instances.

I say that all the time. Every time I hear someone say they hate lawyers...I file it into my brain vault. Then I throw that crap back in their face when they eventually need one. ijs

A good lawyer is one who wins. Since winning is 50/50 from get go, it takes a brilliant lawyer to break the odds. My experience- you guessed. 50/50. Learned long ago, do absolutely all you can to avoid needing a lawyer. That doesn't work out- pray.

You might be right, OBSG.....I'm only working on a few hours sleep, so I may have missed it LOL ....I think someone did ask that question in the legal forum, tho....again, assuming that was even what he was talking about, but that may have actually been the joke

And, yeah, attorneys do get a bad rap....sometimes deservedly, but most often not. I have a lot of friends and relatives who went that route, and sometimes I wish I did, because I really enjoy studying legal issues.
