Yes. If that is a code word for fondling for pay. The Prostitution laws criminalizes fondling in all or most of the states. It is important never to ask for FBSM before you are on the table and receiving massage. Undercover cops most likely are not going to massage you. If the massage therapist ask you if you want a blow job, then say "No" before massage. You will not get in trouble if you patronizes an unlicensed massage therapist because there is no law criminalizing the buying of unlicensed massages.
No. Just because they offer it does not mean you will get into trouble. You can claim that you don't understand these code words. Never admit you understand what is FBSM. If they ask you, then just tell them that it means a back rub. Once you admit that FBSM mean fondling, then you committed a crime of soliciting prostitution services. If they have code words for blow jobs like CBJ, BBBJ, etc. on the massage ads then I will avoid such masseuse.
It is very rare for police to bust independent masseuse who offer FBSM. It is very rare or never happen for them to bust their clients of independent masseuse. They do more bust on massage parlors because it is more visible. Police will bust escorts and their clients because it is easier to bust them. With massage, they rarely bust clients because it is not time efficient. There is a portion of clients just looking for pure massage. Police could waste allot of time trying to bust clients of independent masseuse. It is possible they take over a massage parlor for a day or two to bust clients but this is very rare. If they too eager to talk to you about services before the massage, be careful!!
