Sen. Patrick Leahy has abandoned his controversial proposal that would grant government agencies more surveillance power -- including warrantless access to Americans' e-mail accounts -- than they possess under current law.
The Vermont Democrat said today on Twitter that he would "not support such an exception" for warrantless access. The remarks came a few hours after a CNET article was published this morning that disclosed the existence of the measure.

In other words, he was going to slide it through under the radar, until a website a lot of people actually read, found out about it and published it.

So what can they really do, knock on your door and say "we would like to discuss the contents of your emails", or send you a letter or an email to that affect. I don't think any monitoring of email is simply random. I think someone would have to be a suspect and pose considerable concerns to the Gov't.

The article mentioned the emails had to have a subpoena issued.

Doesn't a judge have to sign a subpoena? Since probable cause is in the eye of the beholder, can't a judge willing to sign a subpoena or a search warrant be easily found?
