2 Ninth Circuit Decisions on Federal Sex Trafficking Act
2 Ninth Circuit Decisions on Federal Sex Trafficking Act
1) Issue was a "pimp" convicted of sex trafficking and challenged his 23 year prison sentence based upon arguing the Commerce Clause did not regulate local pimping not across State lines. Also argued that local pimping in Washington State did not violate the definition of "interstate commerce."
He lost his appeal however because:
He showed woman how to access TNABoard.com to post an ad for prostitution services. The servers of TNA are located in Texas and Amsterdam.
Used a computer to upload pictures and post ads on Craigslist which from Washington would have used servers in Arizona or California.
The women used Trogan-brand condoms when she worked as a prostitute. An employee of the company testified the condoms were made in Virginia.
All of this proved Federal jurisdiction and 23 year Federal prison sentence.
Case: USA v. Walls AKA "Tip-Toe" No 13-30223 filed April 21, 2015
