I cannot speak for Y's employer but having been involved in employee terminations over the years most employers will not challenge unless they have their own "ducks" in a row. Termination for cause (a reason for denial of benefits) requires some effort on the employers part to document .......any many employers suck when it comes to actually being able to justify a termination. That's not to say a single incident of willful misconduct such as theft, dishonesty, or a workplace disturbance cannot be sufficient to deny benefits. I've participated in denial cases where the terminated employee was represented by an attorney. In those cases it did not help. Some employers terminate so infrequently they don't even consider the impact on their unemployment insurance rates.
